By accessing and using Pictorix ("the Platform"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access the Platform.

2. Definitions

Platform refers to Pictorix website and services
User refers to any individual accessing the Platform
Photographer refers to professional photographers registered on the Platform
Client refers to users booking photography services
Content refers to images, text, and other materials on the Platform
Deposit: A non-refundable upfront payment made by the client to secure a booking with a photographer through the Platform.

3. Account Registration

3.1 User Accounts

You must provide accurate information when creating an account
You are responsible for maintaining account security
You must be at least 18 years old to create an account
One person may not create multiple accounts

3.2 Photographer Accounts

Photographers must provide professional credentials
Portfolio submissions must be original work
Photographers must maintain accurate availability calendars
Photographers must comply with local business regulations

4. Booking and Payment Terms

4.1 Booking Process

All bookings must be made through the Platform
Prices are displayed in local currency
Booking confirmation is subject to photographer availability
Clients agree to pay a non-refundable deposit at the time of booking to secure their preferred date and time. The remaining balance is paid directly to the photographer after the session.

4.2 Payment Terms

The Platform collects a non-refundable deposit as part of the total investment amount displayed during booking. The remaining balance must be paid by the client directly to the photographer after the session, using a mutually agreed payment method (e.g., cash, Zelle).
Deposits are non-refundable but may be applied as credit toward future bookings if canceled at least 48 hours before the scheduled session.

4.3 Direct Payment Disclaimer

The Platform facilitates bookings by collecting a deposit but does not process or manage payments for the remaining balance owed to photographers. The Platform is not responsible for:

The payment method or process used for the remaining balance (e.g., cash, Zelle).
Ensuring completion of payment or service delivery between clients and photographers.
Resolving disputes related to payments or services provided by photographers.

By using the Platform, you acknowledge that our role is limited to facilitating bookings.

5. Photography Services

5.1 Service Delivery

Session duration as specified in package details
Number of photos as outlined in package description
Delivery timeline as stated in booking confirmation
Weather-related rescheduling policies apply
Clients are responsible for coordinating with photographers regarding any specific requirements or preferences for their session.
Photographers are solely responsible for fulfilling their obligations as outlined in their package descriptions.

5.2 Image Rights

Photographers retain copyright of all images
Usage rights are granted as specified in packages
Commercial usage requires separate licensing
Platform usage rights for marketing purposes

6. User Responsibilities

6.1 Platform Usage

No unauthorized commercial use
No harmful or malicious activities
No interference with Platform operation
Respect other users' privacy
Clients must ensure timely payment of any remaining balances directly to photographers after sessions.

6.2 Content Guidelines

No inappropriate or offensive content
No copyright infringement
No false or misleading information
No spam or unauthorized advertising

7. Intellectual Property

Platform content is protected by copyright
User-generated content ownership remains with users
Limited license granted for Platform features
Trademark and brand protection

8. Liability Limitations

Platform provided "as is"
No guarantee of service availability
No liability for user-generated content
Force majeure conditions apply

The Platform is provided 'as is' and acts solely as an intermediary for booking photography services. We do not guarantee or take responsibility for:

The quality, timeliness, or completion of services provided by photographers.
Any disputes arising between clients and photographers regarding payments or services.

9. Dispute Resolution

Good faith resolution attempt required
Mediation before legal action
Jurisdiction and venue specifications
Class action waiver

The Platform encourages clients and photographers to resolve disputes amicably regarding payments or service delivery issues. The Platform is not obligated to mediate such disputes but may provide limited assistance at its sole discretion.

10. Platform Rules

No harassment or abuse
No fraudulent activities
No data scraping
No unauthorized access attempts

10.2 Content Moderation

Right to remove inappropriate content
Account suspension for violations
Appeal process for moderation decisions

11. Termination
